PUBLIC AGREEMENT (OFFER)
This Agreement is an official offer (public offer) of the individual entrepreneur Balytskyi Sviatoslav Petrovych (TIN 2578322977), hereinafter referred to as the "Seller," to conclude a contract under the terms set out below with any person who accepts this offer (hereinafter referred to as the "Buyer").
1. GENERAL PROVISIONS
1.1. This Agreement is a public contract (offer) in accordance with Articles 633, 641 of the Civil Code of Ukraine and has legal force in accordance with the current legislation of Ukraine and the European Union.
1.2. The placement of this Agreement on the website https://ministryofbra.com/ is a public offer to conclude a contract under the terms specified in it.
1.3. Acceptance of this offer occurs by placing an order on the website https://ministryofbra.com/ and is confirmed by the fact of payment by the Buyer.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to transfer ownership of the goods presented on the website to the Buyer, and the Buyer undertakes to accept and pay for them under the terms of this Agreement. 2.2. The names, assortment, price, and other characteristics of the goods are indicated on the website pages.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The Seller undertakes to:
- Provide the Buyer with goods that match the description on the website;
- Ensure proper packaging of the goods before their transfer to the Buyer;
- Fulfill other obligations in accordance with the current legislation of Ukraine and the EU. 3.2. The Buyer undertakes to:
- Accept and pay for the goods within the period specified in this Agreement;
- Familiarize themselves with the product information before placing an order;
- Comply with the terms of this Agreement.
4. ORDER PLACEMENT AND PAYMENT PROCEDURE
4.1. The Buyer places an order through the website by adding selected goods to the cart and filling in the necessary data. 4.2. Payment is made in a cashless form through the available payment systems on the website. 4.3. Payment for the goods confirms acceptance of the offer.
5. DELIVERY OF GOODS
5.1. Delivery is carried out in the manner chosen by the Buyer when placing an order. 5.2. The Seller is not responsible for delivery delays caused by the transport company.
6. WARRANTY OBLIGATIONS AND RETURNS
6.1. The Buyer has the right to return the goods in accordance with the current legislation of Ukraine and the EU. 6.2. According to the Resolution of the Cabinet of Ministers of Ukraine No. 172 dated 19.03.1994, underwear belongs to the list of goods that are not subject to return or exchange.
7. LIABILITY OF THE PARTIES
7.1. The Parties are liable for non-fulfillment or improper fulfillment of the terms of this Agreement in accordance with current legislation.
8. PERSONAL DATA
8.1. The Seller guarantees compliance with current legislation on the protection of personal data, including the General Data Protection Regulation (GDPR). 8.2. The use of the Buyer’s personal data is carried out exclusively for the fulfillment of obligations under this Agreement.
9. FORCE MAJEURE
9.1. The Parties are released from liability for non-performance of obligations in case of force majeure circumstances.
10. TERM OF THE AGREEMENT
10.1. The Agreement enters into force from the moment of the Buyer's acceptance of the offer and remains in effect until the full fulfillment of the obligations by the Parties. 10.2. The Seller has the right to change the terms of the offer without prior notice, and the changes take effect from the moment of their publication on the website.
